About Water Law

Each state and territory has separate legislation governing the water within its borders. Additional to each state/territory’s water law, Australia has Commonwealth legislation which acts in conjunction with the state/territory laws to manage Australian water to maintain national interests.

Overall, each piece of legislation aims to create water security, govern the use and management of water in Australia and achieve efficient and cost-effective management and administrative processes.

The Commonwealth and state/territory water is owned by the Crown and is subject to the Crown’s rule.
