Water Access Entitlement

A person can apply to the Minister for a water access entitlement.

A water access entitlement provides an entitlement to the amount of surface or groundwater which is specified in the entitlement.

The water access entitlement may be subject to conditions which would be specified on the enititlement.

Licence to Take Water

A person is not permitted to take water from a certain place unless that have a licence to take water.

A person must also have a water access entitlement in order to pertain a licence to take water.

A licence to take water is a licence permitting a person to take water from a specific water management area stated in the water access entitlement on which the licence is based, a place in a waterway downstream from the water management area and any other water management area for which the individual holds a water access entitlement.

Other licences:

The following are other licences an individual can apply for/receive to complete the following work:

  • Drillers licence - required in order to complete bore work.

  • Bore work licence - a person who is the owner/occupier of land cannot allow bore work to be completed unless the person has a bore work licence.

  • Waterway work licence - a person must have a waterway work licence in order to construct or alter a water structure or complete other work on a waterway.

  • Recharge licence - in order to increase the quantity of ground water, a person must have a recharge licence.

6 Objects of Act 

The objects of this Act are— 

(a) to ensure that management and use of the water resources of the Territory sustain the physical, economic and social wellbeing of the people of the ACT while protecting the ecosystems that depend on those resources; and 

(b) to protect aquatic ecosystems and aquifers from damage and, where practicable, to reverse damage that has already happened; and 

(c) to ensure that the water resources are able to
